Humanitarian and Compassionate Considerations (H&C)

Humanitarian and Compassionate Considerations

You may be eligible for permanent residence in Canada on humanitarian and Compassionate grounds if you are a foreign national living in Canada (or outside sometimes) who needs an exemption (on sufficient and compelling reasons) from one or more requirements of the IRPA or regulations to apply for permanent residence within Canada and are not eligible to apply for permanent residence within Canada under any other immigration class. You will need someone like a spouse or a partner who is a Canadian citizen or a permanent resident to sponsor your application.

You may not use this application if you have already claimed asylum or are a designated foreign national for the past 5 years.

Factors in consideration: Key pointers in consideration on H&C grounds would be your establishment in Canada, your inability to leave Canada, your ties to Canada, best interest of any children affected by your application, health considerations, family violence considerations, consequences of your separation, factors in your country of origin etc.
